An Act Respecting The United Church of Canada
WHEREAS The United Church of Canada was incorporated by The United Church of Canada Act, chapter 100 of the Statutes of Canada, 1924;
AND WHEREAS The United Church of Canada Act, chapter 59 of the Acts of New Brunswick, 1924, governs the property, rights and powers of The United Church of Canada in New Brunswick;
AND WHEREAS The United Church of Canada’s 42nd General Council adopted a motion on August 14, 2015 to restructure the governance of The United Church of Canada and undertook a remit process, the results of which were confirmed on July 22, 2018, by The United Church of Canada’s 43rd General Council;
AND WHEREAS The United Church of Canada Act, chapter 100 of the Statutes of Canada, 1924, was amended by An Act to amend The United Church of Canada Act, chapter 31 of the Statutes of Canada, 2019, to reflect the changes to the governance structure of The United Church of Canada;
AND WHEREAS The United Church of Canada prays that it be enacted as hereinafter set forth;
THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Definition of “constituting Act”
1 In this Act, “constituting Act” means The United Church of Canada Act, chapter 59 of the Acts of New Brunswick, 1924.
Interpretation
2 In the constituting Act, including in Schedule “A” of that Act, unless the context otherwise requires,
aa reference to “Conference” or “Presbytery” shall be deemed to include
( i) a reference to a Regional Council of The United Church, or
( ii) a reference to a successor of a Regional Council, established in accordance with the process set out in the Basis of Union,
ba reference to “Congregation” shall be deemed to include
( i) a reference to a community of faith, or
( ii) a reference to a successor of a congregation or community of faith, established in accordance with the process set out in the Basis of Union, and
ca reference to the “General Council”, to the “General Council of The United Church” or to the “General Council of The United Church of Canada” shall be deemed to include
( i) a reference to the Denominational Council of The United Church, or
( ii) a reference to a successor of that Denominational Council, established in accordance with the process set out in the Basis of Union.
Right of Appeal to Denominational Council
3 Despite section 2, the following references to “Conference” in item 6 of Column Two of Schedule “A” of the constituting Act shall be deemed to be references to the Denominational Council of The United Church or to a successor of that Denominational Council, established in accordance with the process set out in the Basis of Union:
athe reference to a decision’s being subject to appeal to a “Conference”;
bthe reference to the consent of a “Conference”; and
cthe reference to a certificate of the secretary or clerk of a “Conference”.
