An Act Respecting the Family Law Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Enforcement of Money Judgments Act
1( 1) Section 1 of the Enforcement of Money Judgments Act, chapter 23 of the Acts of New Brunswick, 2013, is amended in the definition “dependant” by striking out “section 111 of the Family Services Act,” and substituting “section 1 of the Family Law Act,”.
1( 2) Subsection 2(3) of the French version of the Act is amended by striking out “des ordonnances de soutien que prévoit la Loi sur l’établissement et l’exécution réciproque des ordonnances de soutien ou la Loi sur l’exécution des ordonnances de soutien” and substituting “des ordonnances alimentaires que prévoit la Loi sur l’établissement et l’exécution réciproque des ordonnances alimentaires ou la Loi sur l’exécution des ordonnances alimentaires.
Family Income Security Act
2( 1) The heading “Payment under Family Services Act” preceding section 11 of the Family Income Security Act, chapter 154 of the Revised Statutes, 2011, is repealed and the following is substituted:
Application for support order by the Minister
2( 2) Subsection 11(1) of the Act is repealed and the following is substituted: 
11( 1) If a person has an obligation under the Family Law Act to provide support for another person and refuses or neglects to provide that support and, as a result of the refusal or neglect, assistance is applied for in respect of that other person, the Minister, with or without the consent of the person entitled to support, may apply for an order under the Support Enforcement Act against the person who has an obligation to provide support and may invoke all the provisions of that Act with respect to obtaining the relief and enforcing orders made under that Act.
2( 3) The Act is amended by adding after section 11 the following: 
Assignment to the Minister
11.1 A person in need may assign a support order to the Minister on a form provided by the Minister.
2( 4) Paragraph 13.1(4)(e) of the Act is repealed and the following is substituted:
eat a trial, hearing or proceeding under the Criminal Code (Canada), or in the Family Division of the Court of Queen’s Bench of New Brunswick, in relation to any matter under this Act, or to a barrister or solicitor acting on behalf of any government, local government or agency and responsible for the institution of such a trial, hearing or proceeding,
Family Services Act
3( 1) Section 1 of the Family Services Act, chapter F-2.2 of the Acts of New Brunswick, 1980, is amended
aby repealing the definition “child” and substituting the following:
“child” means a person actually or apparently under the age of majority, unless otherwise specified or prescribed in this Act or the regulations, and includes (enfant)
aan unborn child,
ba stillborn child,
ca child whose parents are not married to one another,
da child to whom a person stands in the place of a parent, if that person’s spouse is a parent of the child, and
ewhen used in reference to the relationship between an adopted person and the person adopting or the relationship between a person and their birth mother or birth father, a person who has attained the age of majority;
bin paragraph (b) of the definition “parent” by striking out “Parts III, IV and VII,” and substituting “Parts 3 and 4,”.
3( 2) Subparagraph 39(1)(c)(iii) of the Act is repealed and the following is substituted:
( iii) to pay such support as the court may establish in accordance with the Family Law Act;
3( 3) Subsection 51(3) of the Act is amended by striking out “ordinarily resident” and substituting “habitually resident”.
3( 4) Subsection 55(5) of the Act is repealed and the following is substituted:
55( 5) Where a custody order is made, the court shall determine the support obligations of the parent and may make any order with respect to the support of the child that it is authorized to make under the Family Law Act.
3( 5) Subsection 58(5) of the Act is repealed and the following is substituted:
58( 5) The court shall, at the time of making a protective intervention order, determine the responsibilities of the person to the person’s dependants as defined in the Family Law Act, and may make any order with respect to the support of the dependants that it is authorized to make under that Act.
3( 6) Paragraph 85(2)b) of the French version of the Act is amended by striking out “de soutien” and substituting “alimentaires”.
3( 7) The heading “PART VII SUPPORT OBLIGATIONS, CUSTODY AND ACCESS” preceding section 111 of the Act is repealed.
3( 8) Part VII of the Act is repealed.

Fatal Accidents Act
5( 1) Section 1 of the Fatal Accidents Act, chapter 104 of the Revised Statutes, 2012, is amended by repealing the definition “spouse” and substituting the following: 
“spouse” includes (conjoint)
aa person to whom the deceased, at the time of death, owed an obligation to provide support under subsection 14(2) of the Family Law Act,
ba person to whom the deceased, at the time of death, would have owed an obligation to provide support under subsection 14(2) of the Family Law Act but for the fact that the person was not substantially dependent on the deceased for support, and
ca former spouse, including a person described in paragraph (a) or (b), to whom the deceased, at the time of death, was providing support or was obliged to provide support.
5( 2) Paragraph 18(c) of the Act is amended by striking out “or the Family Income Security Act, or the Family Services Act” and substituting “the Family Income Security Act, the Family Services Act, the Family Law Act.
Intercountry Adoption Act
6 Subsection 40(2) of the French version of the Intercountry Adoption Act, chapter I-12.01 of the Acts of New Brunswick, 1996, is amended
ain paragraph a) by striking out “au soutien” and substituting “aux aliments”;

Interjurisdictional Support Orders Act
7( 1) The title of the French version of the Interjurisdictional Support Orders Act, chapter 102 of the Revised Statutes, 2016, is amended by striking out “ordonnances de soutien” and substituting ordonnances alimentaires.
7( 2) Section 1 of the Act is amended
ain the French version by repealing the following definitions:

“support order” means an order or interim order, made by a court or by an administrative body, that requires the payment of support, and includes (ordonnance alimentaire)

7( 19) Section 17 of the Act is amended

17( 2.1) Despite subsection (2), if no party to an order resides in New Brunswick, a designated authority shall forward a copy of the order, in the prescribed manner, to the court administrator in the judicial district in which the designated authority reasonably believes that the party liable to pay support has property or a source of income.

7( 20) Section 18 of the Act is amended

18( 6) The duration of the support obligation set out in an order referred to in subsection (1) shall be governed by the law under which the order was made.
18( 7) The onus shall be on the appropriate authority of the reciprocating jurisdiction to provide proof of the law governing the duration of the support obligation to the satisfaction of the designated authority.
18( 8) Despite subsection (7), if the designated authority is unable to determine the duration of the support obligation under the law specified, the designated authority shall apply the law of New Brunswick to determine the duration of the support obligation.
7( 21) Section 19 of the Act is amended

19( 1.1) If the parties to an order reside outside New Brunswick, the designated authority shall notify the party liable to pay support of the registration of the foreign order under section 18 by ordinary mail at the latest known address of the party as provided by the appropriate authority in the reciprocating jurisdiction.

37.1( 2) The designated authority may respond to a request to locate by advising the appropriate authority in the reciprocating jurisdiction whether or not the person has been located in New Brunswick, but must not disclose specific information respecting the location of the person.
37.1( 3) Information received under subsection (1) by a designated authority is confidential, except that the designated authority may use and disclose the information for the purpose of carrying out its duties and powers in accordance with this Act and the regulations.

24 If in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Loi sur l’établissement et l’exécution réciproque des ordonnances de soutien, it shall be read, unless the context otherwise requires, as a reference to the Loi sur l’établissement et l’exécution réciproque des ordonnances alimentaires.

Continued application of provisions of the Interjurisdictional Support Orders Act
26( 1) Despite paragraph 7(14)(d) of this Act, on the commencement of this section, an order for further information or documents made under subsection 10(2) of the Interjurisdictional Support Orders Act, that was in force immediately before the commencement of this section, is valid and continues in force and subsection 10(4) of that Act, as it existed immediately before the commencement of this section, applies to the receipt of the information or documents.
26( 2) Despite paragraph 7(34)(d) of this Act, on the commencement of this section, an order for further information or documents made under subsection 28(2) of the Interjurisdictional Support Orders Act, that was in force immediately before the commencement of this section, is valid and continues in force and subsection 28(4) of that Act, as it existed immediately before the commencement of this section, applies to the receipt of the information or documents.
26( 3) Despite paragraphs 7(15)(a) and 7(35)(a) of this Act, subsections 12(1) and 29(1) of the Interjurisdictional Support Orders Act, as they existed immediately before the commencement of this section, continue to apply to an application for support heard by a court of New Brunswick before the commencement of this section.
Repeal of An Act to Amend the Support Enforcement Act
27 An Act to Amend the Support Enforcement Act, chapter 29 of the Acts of New Brunswick, 2014, is repealed.
Repeal of An Act to Amend the Interjurisdictional Support Orders Act
28 An Act to Amend the Interjurisdictional Support Orders Act, chapter 1 (Supp.) of the Revised Statutes, 2016, is repealed.
Commencement
29 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
