Statute Law Amendment Act 2019
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Archives Act
1( 1) Section 1 of the Archives Act, chapter A-11.1 of the Acts of New Brunswick, 1977, is amended
aby repealing the definition “community board”;
bby repealing the definition “school board”;
cin the definition “regional health authority” in the English version by striking out the semicolon at the end of the definition and substituting a period;
dby adding the following definitions in alphabetical order:
“District Education Council” means a District Education Council established under section 36.1 of the Education Act; (conseil d’éducation de district)
“Parent School Support Committee” means a Parent School Support Committee established under section 32 of the Education Act; (comité parental d’appui à l’école)

An Act Respecting the Role of the Attorney General
2 Paragraph 2e) of the French version of An Act Respecting the Role of the Attorney General, chapter 116 of the Revised Statutes, 2011, is amended by striking out “les sous-ministres” and substituting “les responsables des ministères”.
Le Centre communautaire Sainte-Anne Act
3( 1) Section 1 of Le Centre communautaire Sainte-Anne Act, chapter C-1.1 of the Acts of New Brunswick, 1977, is amended
aby repealing the definition “School Board”;  
bin the definition “Minister” in the English version by striking out the semicolon at the end of the definition and substituting a period;
cby adding the following definition in alphabetical order: 
“District Education Council” means the District Education Council established under the Education Act for the school district that includes École Sainte-Anne; (conseil d’éducation de district)
3( 2) Section 2 of the Act is amended
ain paragraph (2)(b)
( i) by repealing subparagraph (i) and substituting the following: 
( i) two of whom shall be councillors from the District Education Council, nominated by the District Education Council, and
( ii) in subparagraph (ii) by striking out “the geographic area designated under the Schools Act in respect of École Sainte-Anne” and substituting “the school district that includes École Sainte-Anne”;

3( 3) Subsection 3(2) of the Act is amended

Civil Service Act
4 Subsection 17(3) of the French version of the Civil Service Act, chapter C-5.1 of the Acts of New Brunswick, 1984, is amended by striking out “mais une telle nomination ne peut être faite si elle fait en sorte que la personne concernée aura travaillé au total plus de deux cent soixante jours payés dans une période de vingt-quatre mois au sein du même élément de la Fonction publique à titre occasionnel ou temporaire” and substituting “, mais une telle nomination ne peut être faite si, dans le cadre de toutes ses nominations précédentes à titre occasionnel ou temporaire au sein du même élément de la Fonction publique, elle a travaillé au total plus de deux cent soixante jours payés dans une période de vingt-quatre mois”.
Coroners Act
5( 1) Subsection 10(2) of the French version of the Coroners Act, chapter C-23 of the Revised Statutes, 1973, is amended by striking out “dûment qualifiées pour être jurés suivant la Loi sur les jurés” and substituting “admissibles à remplir les fonctions de juré en application de la Loi sur les jurés.
5( 2) Section 14 of the Act is amended by striking out “by oath or affidavit” and substituting “by oath, solemn affirmation or affidavit”.
5( 3) The heading “Oath of jurors and witnesses” preceding section 19 of the Act is repealed and the following is substituted:

5( 4) Section 19 of the Act is repealed and the following is substituted:
19 The coroner shall administer an oath or solemn affirmation to each witness in the manner provided in the Evidence Act.
5( 5) The heading “Oath of jurors and witnesses” preceding section 20 of the Act is repealed and the following is substituted:
Oath or solemn affirmation of jurors
5( 6) Section 20 of the Act is repealed and the following is substituted:
20( 1) The coroner shall administer an oath or solemn affirmation to each juror to inquire diligently touching the death of the person on whose body the inquest is about to be held and to give a true verdict according to the evidence.
20( 2) Before administering an oath or solemn affirmation under subsection (1), the coroner shall examine the person under oath or solemn affirmation to determine if the person is qualified to serve as a juror.
20( 3) The coroner shall attach to the inquisition a certificate stating that the coroner examined and found each person named in the certificate to be qualified to serve as a juror.
5( 7) Subsection 23(1) of the Act is amended by striking out “coroner shall examine upon oath, or in cases where affirmation is allowed on affirmation,” and substituting “coroner shall examine under oath or solemn affirmation”.
5( 8) Subsection 31(2) of the Act is amended by striking out “person states upon oath” and substituting “person states under oath or solemn affirmation”.
5( 9) Section 40 of the Act is repealed and the following is substituted:
40 A witness may be examined through an interpreter to whom the coroner shall administer an oath or solemn affirmation to well and truly interpret the oath or solemn affirmation and the questions put to the witness and the answers to those questions.
Cost of Credit Disclosure and Payday Loans Act
6 Subsection 1(1) of the French version of the Cost of Credit Disclosure and Payday Loans Act, chapter C-28.3 of the Acts of New Brunswick, 2002, is amended

Foreign Resident Corporations Act
12 Section 7 of the Foreign Resident Corporations Act, chapter 109 of the Revised Statutes, 2014, is amended by adding after subsection (2) the following:
7( 3) Before the date of application under section 2, the foreign corporation may
awithdraw or amend any or all of the documents filed with the Minister, or
bsubstitute other documents for those filed with the Minister.
Gas Distribution Act, 1999

Underground Storage Act
36( 1) Subsection 9(4) of the Underground Storage Act, chapter U-1.1 of the Acts of New Brunswick, 1978, is repealed and the following is substituted:
9( 4) A person who enters on any land other than Crown lands for the purpose of exploring to evaluate underground storage potential for fluids is liable to pay any person having an interest in the land or in chattels on the land compensation for any loss or damage to the land or chattels caused by reason of the entry, occupation or operation; and if the parties cannot agree as to the amount of compensation, the amount shall be determined by The Court of Queen’s Bench of New Brunswick or any judge of that Court acting under Part 2 of the Expropriation Act on application by either of the parties.
36( 2) Section 10 of the Act is repealed and the following is substituted:
Entry and use of private lands
10 All terms and conditions applying to a special order to enter and use private land issued by the Minister under the Oil and Natural Gas Act apply, with any necessary modifications, to the special order referred to in section 9.
36( 3) Subsection 13(2) of the Act is amended by striking out “underground storage facilities” and substituting “underground storage facilities for fluids”.
