An Act Respecting Family Day
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Days of Rest Act
1 Section 1 of the Days of Rest Act, chapter D-4.2 of the Acts of New Brunswick, 1985, is amended
(a)  in the definition “prescribed day of rest” by adding after paragraph (a) the following:
(a.1)  Family Day,
(b)  by adding the following definition in alphabetical order:
“Family Day” means Family Day as defined in the Employment Standards Act; (jour de la Famille)
Employment Standards Act
2( 1) Section 1 of the Employment Standards Act, chapter E-7.2 of the Acts of New Brunswick, 1982, is amended
(a)  in the definition “public holiday” by striking out “New Year’s Day,” and substituting “New Year’s Day, Family Day,”;
(b)  by adding the following definition in alphabetical order:
“Family Day” means the third Monday in February; (jour de la Famille)
2( 2) Subsection 22(2) of the Act is amended by striking out “three per cent” and substituting “4%”.
2( 3) Section 23 of the Act is amended by striking out “seven” and substituting “eight”.
CONSEQUENTIAL AMENDMENTS AND COMMENCEMENT
Interpretation Act
3 Section 38 of the Interpretation Act, chapter I-13 of the Revised Statutes, 1973, is amended in the definition “holiday” by striking out “New Year’s Day,” and substituting “New Year’s Day, Family Day as defined in the Employment Standards Act,”.
Municipal Elections Act
4 Section 1 of the Municipal Elections Act, chapter M-21.01 of the Acts of New Brunswick, 1979, is amended
(a)  in the definition “holiday” by adding after paragraph (b) the following:
(b.1)  Family Day,
(b)  by adding the following definition in alphabetical order:
“Family Day” means Family Day as defined in the Employment Standards Act; (jour de la Famille)
Provincial Court Act
5 Subsection 1(1) of the Provincial Court Act, chapter P-21 of the Revised Statutes, 1973, is amended
(a)  in the definition “holiday” by striking out “New Year’s Day,” and substituting “New Year’s Day, Family Day,”;
(b)  by adding the following definition in alphabetical order:
“Family Day” means Family Day as defined in the Employment Standards Act; (jour de la Famille)

6 This Act comes into force on January 1, 2018.
