An Act to Amend the Employment Standards Act
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Subsection 36(1.1) of the Employment Standards Act, chapter E-7.2 of the Acts of New Brunswick, 1982, is repealed and the following is substituted:
36( 1.1) An employer may only provide a statement referred to in subsection (1) to an employee electronically if the employer provides to the employee, through the employee’s place of employment,
(a)  confidential access to the electronic statement, and
(b)  a means of making a paper copy of the electronic statement.
2 Section 44.024 of the Act is amended
(a)  in subsection (2) in the portion preceding paragraph (a)
( i) by striking out “eight weeks” and substituting “twenty-eight weeks”;
( ii) by striking out “twenty-six weeks” and substituting “twenty-eight weeks”;
(b)  in subparagraph (3)(b)(ii) by striking out “twenty-six weeks” and substituting “twenty-eight weeks”;
(c)  in subsection (5) by striking out “eight weeks” and substituting “twenty-eight weeks”.
3 Subsection 60(1) of the Act is amended
(a)  by repealing paragraph (h);
(b)  in paragraph (l) by striking out “and” at the end of the paragraph;
(c)  by repealing paragraph (m) and substituting the following:
(m)  the dates of all dismissals or layoffs of the employee and the dates of any notices of dismissals or layoffs; and
(d)  by adding after paragraph (m) the following:
(n)  the date of cessation of employment.
4 Sections 1 and 3 of this Act come into force on January 1, 2017.
