An Act to Amend the Jury
Act
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section
13 of the Jury Act, chapter J-3.1 of the Acts of New Brunswick, 1980,
is amended
(a) in subsection (2)
(i) in the portion
preceding paragraph (a) by striking out “The persons”
and substituting “Subject
to subsection (2.1), the persons”;
(ii) in paragraph
(a) by striking out “from the names of persons apparently resident
in the judicial district or a distinct part of it that are on a list
provided for in the regulations, or” and substituting “from the names of persons on a list
provided for in the regulations who are apparently resident in the
judicial district or the distinct part of it in which the proceeding
is to be conducted, or”;
(iii) in paragraph
(b)
(A) in the portion
preceding subparagraph (i) of the French version by striking out “une
liste prévue aux règlements” and substituting “une liste réglementaire”;
(B) in subparagraph
(ii) by striking out “the names of persons on the list who are
apparently resident in the judicial district or a distinct part of
it” and substituting “the
names of persons on the list who are apparently resident in the judicial
district or the distinct part of it in which the proceeding is to
be conducted”;
(b) by adding after subsection (2) the following:
13(2.1)
The persons to be summoned may be selected under subsection (2) from
the names of persons on the list who are apparently resident in a
judicial district or a distinct part of it other than the judicial
district or the distinct part in which the proceeding is to be conducted
if
(a) the sheriff considers it necessary in order
to summon a sufficient number of persons from which to select a jury,
and
(b) the selection process complies with subsection
(2) in all other respects.
(c) by repealing subsection (3).
