An Act to Amend the
Assessment Act
Her Majesty, by and with the advice and
consent of the Legislative Assembly of New Brunswick, enacts as follows:
1 Section
1 of the Assessment Act, chapter A-14 of the Revised Statutes, 1973,
is amended in the definition “real property”
(a) by adding after paragraph (b.3) the following:
(b.4) the tower and the foundation of
a wind turbine,
(b) in paragraph (l) by
striking out “and” at the end of the paragraph;
(c) in paragraph (m) by
striking out the semicolon at the end of the paragraph and substituting
a comma followed by “and”;
(d) by adding after paragraph
(m) the following:
(n) notwithstanding paragraph (b.4),
the nacelle of a wind turbine;
2 Section
15 of the Act is amended by striking out “15.1” and substituting “15.1, 15.11”.
3 The
Act is amended by adding after section 15.1 the following:
Assessment of
real property in paragraph (b.4) of definition “real property”
15.11 Real property as defined in paragraph (b.4)
of the definition “real property” in section 1 shall be
assessed at a rate or rates prescribed by regulation.
4 Subsection
40(1) of the Act is amended
(a) in paragraph (e.3)
by striking out “(b.2) and (b.3)” and substituting “(b.2), (b.3) and (b.4)”;
(b) in paragraph (e.31)
by striking out “(a) to (m)” and substituting “(a) to (n)”.
5 This Act shall be deemed to have come into
force on January 1, 2007.
